Viscar Beta Tester Agreement

By using the Viscar closed beta — through the iOS app distributed via Apple TestFlight, the website at https://viscarapp.com, or the developer API — you ("you", "Tester") agree to the terms below.

1. Beta status

Viscar is experimental, pre-release software distributed exclusively for testing and evaluation. The Service:

  • May contain bugs, errors, inaccuracies, or critical failures
  • May be temporarily or permanently unavailable
  • May lose, corrupt, or fail to save your data
  • May change, add, or remove features without notice
  • May be terminated at any time without compensation

You acknowledge and accept these risks.

2. Operators and the Service

This beta is operated jointly during the pre-incorporation period by:

  • [Operator A — TBD], California, United States
  • [Operator B — TBD], Poland, European Union

(collectively, the "Operators").

The "Service" includes:

  • The Viscar iOS application distributed through Apple TestFlight
  • The Viscar website at https://viscarapp.com
  • The free-tier Viscar developer API

Software development for the Service is performed by [Polish development company — TBD], a Polish limited liability company engaged by the Operators for this purpose. Developers engaged by [Polish development company — TBD] have technical access to the Service infrastructure.

The Operators intend to incorporate Viscar Inc. (Delaware C-Corporation) within approximately six months. Upon incorporation, all rights and obligations under this Agreement will be assumed by Viscar Inc., and this Agreement will be replaced by a full Terms of Service.

3. Eligibility

You must be at least 18 years old to use the beta. The beta is offered only to individuals invited by the Operators (via TestFlight invitation or website signup approval).

4. Navigation safety — important

The Service provides routing suggestions, related navigation data, and weather data. It is not safety-critical software. Information provided may be inaccurate, incomplete, or out of date.

You agree:

  • Not to rely solely on the Service for navigation
  • To maintain a backup navigation system at all times
  • To follow all applicable traffic laws, road signs, and your own judgment, regardless of any routing suggestion provided by the Service
  • That the Operators are not responsible for any loss, damage, accident, injury, or harm resulting from your use of or reliance on the Service

5. No warranties

The Service is provided "AS IS" and "AS AVAILABLE" without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, completeness, or non-infringement.

6. Limitation of liability

The beta is provided free of charge for testing purposes. To the maximum extent permitted by applicable law, the total aggregate liability of the Operators to you for any and all claims arising out of or relating to your use of the Service is limited to US $0.

Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability for personal injury caused by negligence. These exclusions apply only to the extent permitted by your local law.

7. Acceptable use

You agree not to:

  • Use the Service for any illegal purpose
  • Reverse-engineer, decompile, or disassemble the Service, except as permitted by applicable law
  • Attempt to gain unauthorized access to any part of the Service or its underlying infrastructure
  • Use the Service in a way that interferes with other users or with the infrastructure
  • Resell, sublicense, or commercially exploit the Service or any data obtained through it without prior written consent
  • Use automated tools to scrape, crawl, or systematically extract data from the website or API beyond the documented API endpoints and rate limits
  • Use the Service to build a competing product

8. API use (free beta tier)

If you use the developer API:

Your API key. You receive an API key tied to your account. You are responsible for keeping your API key confidential. Any activity performed using your API key is attributed to you. Notify the Operators at legal@viscar.com immediately if you believe your key has been compromised.

Rate limits and quotas. The free beta tier is subject to rate limits and daily/monthly quotas. The Operators may modify these limits at any time. Exceeding limits may result in throttling or temporary suspension of your API key.

Permitted use of API responses. During the beta, API responses (routes, related telemetry, weather information) are provided for evaluation and integration testing. Use in production applications is at your own risk and subject to all other terms of this Agreement, including the safety disclaimer in Section 4 and the liability limitation in Section 6.

Data from third-party sources. API responses may include data aggregated from third-party providers (such as weather data from Open-Meteo and map data from Apple). You acknowledge that this data is subject to its providers' respective terms and that you must not attempt to extract, separate, or repurpose third-party data from the API responses.

API attribution. When you display or publish anything derived from the API in your own product, you must include attribution to "Viscar" or "Powered by Viscar" in a reasonably visible place, unless the Operators agree otherwise in writing.

9. Feedback

Any feedback, suggestions, bug reports, ideas, or comments you provide to the Operators may be used by the Operators (and by Viscar Inc. upon incorporation) freely, perpetually, worldwide, without compensation or attribution. You retain no rights in such feedback.

10. Confidentiality

The beta includes features, user interface designs, algorithms, API endpoints, and functionality that have not been publicly released. You agree not to publish screenshots, screen recordings, technical documentation, or detailed descriptions of the beta to the general public, social media, or press until public release of Viscar.

You may discuss the beta privately with potential investors, advisors, your own technical team, and your own legal or business counsel under reasonable confidentiality obligations.

11. Account termination

The Operators may suspend or terminate your access to the beta, your account, or your API key at any time, with or without cause and without prior notice, particularly in case of breach of this Agreement or applicable law.

You may stop using the beta at any time by uninstalling the app, ceasing API calls, and requesting account deletion at legal@viscar.com or through your account settings.

12. Privacy

Your personal data is handled in accordance with the Privacy Notice (Beta). By accepting this Agreement, you also acknowledge the Privacy Notice.

13. Term and end of beta

This Agreement begins on the date you accept it and continues until:

  • the beta ends (expected approximately six months from May 15, 2026); or
  • the Operators terminate your access; or
  • you request account deletion; or
  • this Agreement is replaced by a full Terms of Service upon incorporation of Viscar Inc.

At the end of the beta:

  • Your account access will be terminated unless transitioned to the post-beta Service
  • Your API key will be revoked
  • Identifiable personal data will be deleted as described in the Privacy Notice
  • Anonymous trip data will be retained as described in the Privacy Notice

14. Transition to Viscar Inc.

Upon incorporation of Viscar Inc., this Agreement will be automatically novated to Viscar Inc. as the contracting party, and a full Terms of Service will be issued. You will be asked to acknowledge the new document on your next login. If you do not accept the new document, your access will end and your data will be handled as described in the Privacy Notice.

15. Assignment

You may not assign or transfer your rights under this Agreement. The Operators may assign their rights and obligations to Viscar Inc. upon incorporation, or to a successor entity in connection with a merger, acquisition, or reorganization, without your consent.

16. Governing law and jurisdiction

This Agreement is governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.

Any dispute arising out of or relating to this Agreement shall be brought in the state or federal courts located in California, United States, except where mandatory consumer-protection laws of your country of residence grant you the right to bring proceedings in your local courts.

17. Entire agreement

This Agreement, together with the Privacy Notice (Beta), constitutes the entire agreement between you and the Operators regarding the Service. If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect.
